Gucci V. Guccio Gucci Winning Trademark Case

In Florence recently, in an intellectual property case sponsored by Gucci (Gucci) group, a judge vetoed Guccio Gucci and her brother Alessandro Gucci, who were the great grandchildren of Guccio Gucci, founder of Gucci company.

ToBeGSrl, a jewelry company, was accused of violating the trademark of Gucci illegally because of its use of "Gucci" and "Guccio Gucci" for marketing communications and website activities.

The judge concluded that the use of the name "Guccio Gucci" would create an unfair relationship between the products of the ToBeG company and the trademarks of Gucci. At the same time, the judge also considered that his actions constituted an unfair competition and would also cause damage to Gucci, because the advertising materials of the defendant were easily confused with Gucci's products and business activities, and unfairly utilized Gucci's product quality and reputation.

The brand worked for 12 years, leaving in 1989 and helping its father run a GiorgioG handbag series before he founded ToBeG in 2008.

Gucci group is not the first time that it has been forced to take legal measures to protect its name.
