Ningbo, Zhejiang Issued The First Local Regulations On Special Weather Labor Protection

Recently, the executive meeting of the Ningbo municipal government of Zhejiang province examined and approved the "special weather labor protection measures in Ningbo" (referred to as the "measures").

The "measures" will come into effect on May 1, 2015.

According to the relevant person in charge of the Ningbo Safety Supervision Bureau, this is the first local regulation in China for the special weather protection for high temperature, low temperature, typhoon, rainstorm, road icing, strong convection and heavy air pollution.

In recent years, influenced by factors such as El Nino and La Nina phenomenon, all kinds of special weather appear more and more frequently, which brings great impact to the occupational safety and health of employees, and poses serious challenges to labor protection, which brings adverse consequences to the construction of harmonious labor relations and social and economic development.

In terms of labor protection for special weather, there is no systematic system in China.

According to the director of relevant departments of Ningbo City Safety Supervision Bureau, in order to standardize the labor protection work of special weather, protect the health and safety of workers in the production process, further enhance the sense of responsibility of employers, and promote the effective implementation of Ningbo's special weather labor protection work, the Ningbo municipal government promulgated the "special weather labor protection measures in Ningbo" in light of the actual situation.

There are seven chapters and thirty-nine articles in the measures, mainly from the scope of application, types of special weather, service and supervision, basic requirements for labor protection in special weather, labor protection measures to be taken, and legal responsibilities.

The "measures" specify that the labor protection work of special weather should adhere to the principle of putting people first, safety first and prevention first.

The service and supervision are emphasized, and the functions of service and supervision of the administrative departments and relevant social organizations are specifically defined.

The main responsibilities are laid down for the basic requirements of labor protection in special weather, labor protection in high temperature weather, and other labor protection measures in special weather.

The "Regulations" stipulate that the maximum daily temperature reaches 40 degrees centigrade, and outdoor outdoor operations should be stopped.

In order to ensure the implementation of this method and better safeguard the legitimate rights and interests of employers and laborers, the measures set up corresponding legal liabilities. According to the relevant provisions of the administrative penalty law and the actual situation of Ningbo, the corresponding legal liability for violations of relevant provisions of these measures was set up respectively.

If the employer violates these measures, he will be fined below 30000 yuan. If the staff of the relevant departments neglect their duties and engage in malpractices for selfish ends, they shall be ordered to make corrections and be given administrative sanction by the units in charge or the higher authorities. If the circumstances are serious, if they constitute a crime, they shall be investigated for criminal responsibility according to law.
