Import Of Caprolactam Originating In The European Union And The United States Is Subject To Anti-Dumping Duties.

In October 18, 2011, the Ministry of Commerce of People's Republic of China (hereinafter referred to as the Ministry of Commerce) issued the Announcement No. sixty-eighth in 2011, and decided to impose anti-dumping duties on the import of caprolactam originating from the European Union and the United States.

Among them, the EU DSM

The anti-dumping duty rates of DSM Fibre Intermediates B.V. and DSM Chemicals North America (Inc.) are 2.3% and 2.2% respectively.

In December 30, 2015, DSM fiber intermediates and DSM chemical North America jointly submitted an application to the Ministry of Commerce, calling the company name changed to Fibrant Fibrant B.V. and Fibrant Limited (Fibrant), requesting the company to inherit the caprolactam from the original company after the change.

The anti-dumping duty rate applied in the measures was submitted to the board of directors (shareholders' meeting), the change of registration certificate, the situation of shareholders before and after renaming, directors' situation, production capacity, raw material suppliers and sales customers' information, and the relevant certification materials of the local government or the certification documents of the Embassy in People's Republic of China.

The Ministry of Commerce notified China caprolactam industry about the above application.

The caprolactam industry in China did not raise any objection within the stipulated time.

After examination, the Ministry of Commerce held that the existing evidence materials indicated that the change of the name of the DSM fiber intermediate company and the DSM chemical North America company were in conformity with the relevant laws and regulations of their respective countries. The management, production capacity, supplier relationship, customer base and management personnel of caprolactam had not changed before and after the change of company name.

Accordingly, the Ministry of Commerce decides:

First, the Fibrant company (Fibrant B.V.) inherited the 2.3% anti-dumping duty rate and other rights and obligations applicable to the DSM Fibre Intermediates B.V. in the anti-dumping measures of caprolactam.

Caprolactam exported to China from the name of DSM Fibre Intermediates B.V. (DSM)

The 25.5% anti-dumping duty rate applicable to other European Union companies in the caprolactam anti-dumping measures shall be applied.

Two. Fibrant (Fibrant LLC) inherits 2.2% anti-dumping duty rates and other rights and obligations applicable to the DSM Chemicals North America (Inc.) in the anti-dumping measures of caprolactam.

The caprolactam products exported to China under the name of DSM Chemicals North America (Inc.) are applicable to 24.2% anti-dumping duty rates applicable to other US companies in the anti-dumping measures of caprolactam.

It has been implemented since March 12, 2016.
